About these terms

EquaAccess™ is a trade name of Assistive Technology Evaluations & Services LLC ("ATES LLC," "we," "us," or "our"). The EquaAccess apps are developed and distributed by ATES LLC, which holds all rights to the apps and their content. References to "EquaAccess" in these Terms refer to ATES LLC operating under the EquaAccess trade name.

Who can use EquaAccess apps

EquaAccess™ apps are designed for use in educational and clinical settings. They may be used by:

  • Students of any age, including children under 13
  • Parents and legal guardians supporting a student
  • Teachers, therapists, aides, and other school staff
  • Licensed clinicians and the school districts and institutions that deploy the apps

No account, login, or personal information is required to begin using an EquaAccess™ app. Anyone can open the app and start using it right away.

How the apps handle data

EquaAccess™ apps are privacy-first. We do not create user accounts, do not show advertising, do not use third-party tracking or analytics, and do not sell or share personal information. How data is handled depends on the edition:

  • School edition: Student data is stored on the device. The School edition does not transmit data over the internet or to external servers. Optional local clinician pairing (encrypted, with on-device approval) can transfer session data to a paired clinician device for in-person supervised review.
  • Pro and Clinician editions: These editions add optional features. When optional AI prediction features are used, the current phrase being composed is sent over a secure encrypted connection to our prediction service to generate suggestions. Optional location features may check the device’s region to select the applicable academic standards. These editions also support clinician pairing and staff report export.
  • All editions: Authorized staff may export reports as PDF files and choose to share them; that sharing is an action taken by the staff member, not by the app.

Designed for educational compliance

EquaAccess™ apps are built to support schools and districts in meeting their obligations under:

  • COPPA (Children’s Online Privacy Protection Act)
  • FERPA (Family Educational Rights and Privacy Act)
  • IDEA (Individuals with Disabilities Education Act) accessibility requirements
  • ADA (Americans with Disabilities Act) digital accessibility standards

We do not create accounts, serve advertising, or sell personal data, and the School edition does not transmit data over the internet. Schools, districts, and clinicians remain responsible for obtaining any consents and following any procedures required under these laws for their particular use of student data.

Use in schools and districts

Schools and school districts are welcome to distribute EquaAccess™ apps to students and staff through Apple School Manager or any standard iOS deployment method. No special license is required for standard educational use.

If your district requires a Data Privacy Agreement (DPA) or similar document, please contact us at hello@equaaccess.com. We are happy to work with you on a DPA, executed by Assistive Technology Evaluations & Services LLC, that accurately describes how the relevant edition handles data.

Acceptable use

We ask all users to use EquaAccess™ apps as intended: as accessibility and communication tools that support learning and independence. Please do not:

  • Attempt to reverse-engineer, copy, or redistribute the app or its contents
  • Use the app in any way that could harm another person
  • Misrepresent yourself as affiliated with EquaAccess™ or Assistive Technology Evaluations & Services LLC

These are simple guidelines. We trust our users and do not anticipate issues.

Intellectual property

EquaAccess™ apps, including all software, design, graphics, and content, are owned by Assistive Technology Evaluations & Services LLC and protected by applicable copyright and intellectual property law. Your use of the app does not transfer any ownership rights to you.

Symbol images, vocabulary content, and communication materials within the app are licensed or created for use within the app only and may not be extracted or redistributed.

No warranties

EquaAccess™ apps are provided "as is." We work hard to make them reliable and accurate, but we cannot guarantee the app will be available at all times or free from errors. Assistive Technology Evaluations & Services LLC is not liable for any interruption of service.

EquaAccess™ apps are tools to support communication and learning. They are not a substitute for professional evaluation, therapy, or medical advice. If you have concerns about a student’s communication needs, please consult a qualified speech-language pathologist or assistive technology specialist.

Changes to these terms

If we update these Terms of Use, we will post the revised version on this page with an updated date. For significant changes, we will include a note in the App Store release notes. Continued use of the app after changes are posted means you accept the updated terms.
